This website, niavita.com, is operated by NIAVITA. Throughout the site, the terms “we”, “us” and “our” refer to NIAVITA. NIAVITA offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including the additional policies referenced here and available by hyperlink. These Terms apply to all users of the site, including browsers, customers and contributors of content.

Please read these Terms carefully before using our website. If you do not agree to them, please do not use the website or the Services. Our store is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you.

Section 2 – Online store terms

By agreeing to these Terms, you confirm that you are at least the age of majority in your country of residence. You may not use our products for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction when using the Service. You must not transmit any worms, viruses or code of a destructive nature. A breach of these Terms may result in the termination of your access to the Service.

Section 3 – General conditions

We may refuse Service to anyone for a legitimate reason. Your content (not including payment card information) may be transferred over various networks; payment card information is always encrypted during transfer. You agree not to reproduce, copy, sell or exploit any part of the Service without our written permission. The headings in these Terms are for convenience only.

Section 4 – Accuracy of information

We do our best to keep the information on this site accurate and up to date. Product photos and colors are shown as accurately as possible, but we cannot guarantee that your screen displays every color exactly. If we find an error, we will correct it as soon as possible.

Section 5 – Prices, taxes and payment

Prices are shown in US dollars (USD). Shipping is free on all orders. For customers in the European Union, prices include VAT where applicable. For deliveries outside the European Union, local import duties or taxes may apply; they are set by your country’s customs authority and are paid by you on delivery (see our Shipping Policy).

Payment is made securely at checkout through Shopify Payments. Your order is confirmed by email once payment is accepted. Prices may change at any time, but the price that applies to your order is the one shown when you place it.

Section 6 – Products

Some products may be available only online and in limited quantities. Returns and refunds follow our Refund Policy. We may limit the quantities of any product, or stop selling a product, at any time. Product descriptions and prices may change without notice.

Section 7 – Orders, billing and account information

We may refuse or cancel an order, for example if a product is out of stock, if there is an obvious pricing error, or if we suspect fraud. If we cancel an order you have already paid for, we will notify you by email and refund you in full. We may also limit quantities per person, per household or per order.

You agree to provide current, complete and accurate purchase and account information, and to keep it up to date so that we can complete your order and contact you if needed.

Section 8 – Shipping and delivery

Delivery areas, processing times and estimated delivery times are described in our Shipping Policy. Risk of loss passes to you when the parcel is delivered to you or to a person you designate.

Section 9 – Returns, right of withdrawal and legal guarantee

We offer a 30-day return policy, described in our Refund Policy.

If you live in the European Union or the United Kingdom, you also have a legal right to withdraw from your purchase within 14 days of receiving it, without giving any reason. Our 30-day return policy includes this right and does not limit it.

If you live in the European Union, you also benefit from the legal guarantee of conformity for 2 years from delivery. If a product is defective or does not match its description, contact us at contact@niavita.com: we will repair, replace or refund it at no cost to you, as provided by law.

Section 10 – Optional tools

We may provide access to third-party tools that we do not monitor or control. Such tools are provided “as is” and “as available”, and your use of them is at your own discretion. You should review the terms of the relevant third-party providers.

Section 11 – Third-party links

Some content or services on our site may include links to third-party websites that are not affiliated with us. We are not responsible for the content, accuracy, products or practices of those websites. Please review their policies before engaging in any transaction with them.

Section 12 – Comments, feedback and other submissions

If you send us ideas, suggestions or other materials (“comments”), you agree that we may use them without restriction and without compensation. We may remove content that we consider unlawful, offensive, threatening, defamatory or that infringes the rights of others. You are responsible for the comments you send and their accuracy, and you may not use a false email address or impersonate someone else.

Section 14 – Errors, inaccuracies and omissions

Our site may occasionally contain errors in product descriptions, pricing, promotions, shipping times or availability. We may correct them and update information at any time. If an error affects an order you have already placed, we will contact you before shipping, and you may cancel for a full refund.

Section 18 – Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force.

Section 19 – Termination

These Terms remain in effect until terminated by you or by us. You may stop using our Service at any time. Obligations incurred before termination, including those relating to orders already placed, survive termination.

Section 20 – Entire agreement

These Terms and the policies published on this site form the entire agreement between you and us regarding the Service. Our failure to enforce any right or provision does not waive that right.

Section 21 – Governing law and disputes

These Terms are governed by Belgian law. If you are a consumer living in another country, you also keep the protection of the mandatory rules of your country of residence.

If you have a complaint, please contact us first at contact@niavita.com: we will do our best to find a solution with you. If no amicable solution is found, the courts of Brussels (Belgium) have jurisdiction, without prejudice to your right as a consumer to bring a claim before the courts of your place of residence.

We may update these Terms by posting a new version on this page. The version that applies to your order is the one in force on the date you place it.
